In data 21 Martie 2020, au fost publicate in Monitorul Oficial Ordonanta de Urgenta nr. 30/2020 pentru modificarea si completarea unor acte normative (“OUG nr. 30/2020”) si Hotararea Guvernului nr. 217/2020 (“HG nr. 217/2020”) pentru aplicarea prevederilor Legii nr. 19/2020 privind acordarea unor zile parintilor pentru supravegherea copiilor, in situatia inchiderii temporare a unitatilor de invatamant (“Legea nr. 19/2020”).
OUG nr. 30/2020 si HG nr. 217/2020 au intrat in vigoare la data de 21.03.2020.
I. Noutati aduse OUG nr. 30/2020
1. Persoane carora nu li se aplica prevederile Legii nr. 19/2020:
- beneficiarii indemnizatiei de concediu pentru cresterea copilului;
- persoane care au calitatea de asistent personal al unuia dintre copiii aflati in intretinere;
- persoane care se afla in concediu de odihna/ concediu fara plata;
- persoane ale caror raporturi de munca (inclusiv ale sotului/ sotiei) sunt suspendate pentru intreruperea temporara a activitatii angajatorului, in conditiile art. 52 alin. (1) lit. (c) din Codul Muncii (i.e. somaj tehnic) si
- persoanele ale caror sot/ sotie nu realizeaza venituri (i.e. din salarii si asimilate salariilor, venituri din activitati independente sau venituri din drepturi de proprietate intelectuala, activitati agricole etc.).
2. Conditii referitoare la plata si decontarea de catre Statul Roman
- plata se realizeaza de catre angajator si este, pentru fiecare zi libera:
- 75% din salariul corespunzator unei zile lucratoare si
- nu mai mult de corespondentul pe zi a 75% din castigul salarial mediu brut;
- indemnizatia este supusa platii impozitului, respectiv a contributiilor sociale si de sanatate.
- sumele pentru plata indemnizatiei se ramburseaza de catre Statul Roman.
- angajatorii pot cere numai decontarea sumelor reprezentand indemnizatia neta primita de salariati;
- contravaloarea impozitului si a contributiilor se suporta de catre angajatori.
- plata se realizeaza de catre angajator si este, pentru fiecare zi libera:
II. Prevederi relevante ale HG nr. 217/2020
1. Zilele libere platite pentru unul dintre parinti reprezinta zilele lucratoare pana la incetarea situatiei de urgenta decretata, cu exceptia zilelor lucratoare din perioada vacantelor scolare.
2. Documentele pe care parintii trebuie sa le transmita angajatorului:
- cerere,
- declaratie pe propria raspundere a celuilalt parinte, din care sa rezulte ca acesta nu a solicitat la locul sau de munca zile libere si ca nu se afla in una dintre situatiile de incompatibilitate (i.e. declaratie standard, anexa la HG nr. 217/2020);
- copie a certificatului de nastere al copilului.
3. Documente pe care angajatorii trebuie sa le depuna la agentiile de ocupare a fortei de munca pentru rambursarea indemnizatiilor:
- cerere,
- lista angajatilor care au beneficiat de zile libere si indemnizatia acordata pe aceasta perioada,
- copii de pe statele de plata din care sa reiasa acordarea indemnizatiei,
- declaratie pe proprie raspundere a reprezentantului legal al angajatorului prin care se atesta ca lista contine persoanele care beneficiaza de prevederile Legii nr. 19/2020 (i.e. declaratie standard ce urmeaza a se aproba de catre autoritati) si
- dovada platii contributiilor si impozitelor aferente lunii in care s-a platit indemnizatia.
4. Rambursarea se realizeaza in termen de 60 de zile calendaristice de la inregistrarea solicitarii angajatorilor.

On 21 March 2020, the Government Emergency Ordinance no. 30/2020 for the amendment and completion of some normative acts (“GEO no. 30/2020”) and the Government Decision no. 217/2020 (“GD no. 217/2020”) for the application of the Law no 19/ 2020 granting free days for parents supervising their children in case of temporarily closure of educational units (“Law no. 19/2020”) have been published in the Romanian Official Gazette.
GEO no. 30/2020 and GD no. 217/2020 entered into force on 21 March 2020.
I. Novelties brought by the GEO no. 30/2020
1. Individuals whom the provisions of the Law no. 19/2020 do not apply:
- beneficiaries of the child-care leave indemnifications;
- persons acting as personal assistant of one of their children in care;
- persons who are on holiday/unpaid leave;
- to those whose employment relationships (including their husband/ spouse) are suspended for the temporary interruption of the activity of their employer, according to art. 52 para (1) letter (c) of the Labor Law (i.e. technical unemployment) and
- persons whose husband/ spouse does not register any income (i.e. from wages and income assimilated to wages from independent activities or any income from intellectual property rights, agricultural activities etc.).
2. Conditions related to the payment and the reimbursement by the Romanian State
- payment is made by the employer and, for each free day:
- it amounts to 75% of the wage corresponding to one working day, and
- it shall not exceed 75% of the gross medium wage;
- the received indemnification is subject to taxes, social and health contributions;
- said amounts shall be reimbursed by the Romanian State.
- the employers will only be reimbursed for the net amount, received by the employees.
- the employers will bear the value of the taxes and contributions.
- payment is made by the employer and, for each free day:
II. Relevant provisions of the GD no. 217/2020
1. The free paid days for one of the parents represent the working days until the end of the emergency situation decreed, except for the working days during the school holidays.
2. Documents that parents must provide to the employer:
- written request,
- statement of the other parent confirming that they did not request free days from their employer and that they are not in one of the incompatibility situations (standard statement, appendix to the GD no 217/2020);
- copy of the child’s birth certificate.
3. Documents that employers must file to the county employment agencies for the reimbursement of the indemnifications:
- written request,
- list of the employees who benefited from free days and the indemnification granted during this period,
- copies of the payment proof, attesting that the indemnification was granted,
- a statement of the legal representative of the employer confirming that the list contains individuals who may benefit from the provisions of the Law no. 19/2020 (i.e. standard statement to be approved by the authorities) and
- proof of payment of the contributions and taxes related to the month in which the indemnification was paid.
4. Reimbursement shall be made within 60 calendar days as of the registration of the employer’s request.
