In data de 10 august 2020 a fost publicata in Monitorul Oficial Ordonanta de Urgenta a Guvernului nr. 132/ 2020 pentru instituirea unor masuri de sprijin destinate salariatilor si angajatorilor […] (“OUG nr. 132/2020”).
OUG nr. 132/2020 a intrat in vigoare de la data de 10 august 2020, cu exceptia dispozitiilor referitoare la regimul sanctionator care vor intra in vigoare in 30 de zile de la data publicarii.
I. Reducerea timpului de munca cu pana la 50%
In cazul reducerii temporare a activitatii cauzate de instituirea starii de urgenta/ alerta/ asediu, angajatorul are posibilitatea de a reduce timpul de munca al salariatilor cu cel mult 50% din durata prevazuta in contractul individual de munca (“CIM”), conditionat de indeplinirea urmatoarelor conditii:
- masura reducerii timpului de munca afecteaza cel putin 10% din numarul de salariati ai unitatii;
- reducerea activitatii este justificata de o diminuare a cifrei de afaceri (i) din luna anterioara aplicarii masurii sau, cel mult, (ii) din luna dinaintea lunii anterioare acesteia cu cel putin 10% fata de luna similara a anului anterior;
- este realizata consultarea prealabila a sindicatului, a reprezentantilor salariatilor sau a salariatilor;.
- reducerea are loc pentru o perioada de cel putin 5 zile lucratoare consecutive;
- decizia se comunica salariatului cu cel putin 5 zile inainte de aplicarea efectiva a masurii si se transmite in REVISAL (cel tarziu) in ziua anterioara aplicarii.
Pe durata reducerii timpului de munca, salariatii afectati beneficiaza de o indemnizatie de 75% din diferenta dintre salariul de baza brut prevazut in CIM si salariul de baza brut aferent orelor de munca efectiv prestate.
II. Dispozitii privind indemnizatia
Indemnizatia mentionata este suportata de angajator si se deconteaza din bugetul asigurarilor pentru somaj.
Procedura de decontare a sumelor, precum şi perioada de aplicare a măsurii se stabilesc prin hotărâre a Guvernului (a fi emisa in urmatoarele 30 zile).
In situatia in care angajatorul nu recupereaza indemnizatia de la bugetul asigurarilor pentru somaj, acesta nu are dreptul de a o recupera de la salariat.
Angajatorii datoreaza contributia asiguratorie pentru munca pentru perioada reducerii timpului de munca, atat pentru drepturile salariale aferente timpului de munca lucrat, cat si pentru indemnizatie.
Indemnizatia nu se cumuleaza (pentru acelasi salariat) cu:
- masura pentru sprijinirea incadrarii in munca pe perioada determinata (reglementata de aceeasi OUG nr. 132/2020);
- masurile active de sprijin acordate potrivit art. I si III din OUG nr. 92/2020 (i.e. decontarea unei parti din salariu, pentru o perioada de 3 luni si, respectiv, beneficiile pentru incadrarea in munca a anumitor categorii de persoane in perioada 1 iunie 2020 – 31 decembrie 2020);
- masurile de stimulare a angajatorilor finantate din bugetul asigurarilor pentru somaj prevazute de Legea nr. 76/2002.
II. Interdictii
In perioada de reducere a timpului de lucru sunt interzise:
- angajarea de personal pentru prestarea unor activitati identice ori similare cu cele prestate de catre salariatii al caror timp de munca a fost redus;
- subcontractarea de activitati desfasurate de salariatii al caror timp de munca a fost redus.
Interdictia se raporteaza si la nivel de filiala, sucursala sau alte sedii secundare definite de Legea societatilor nr. 31/1990.
- prestarea de munca suplimentara de catre salariatii afectati;
- reducerea programului de lucru pentru salariati in temeiul art. 52 alin. (3) din Legea nr. 53/2003 privind Codul muncii;
- initierea de concedieri colective.
II. Telemunca
Primirea la munca sau prestarea oricarui alt tip de munca, inclusiv in regim de telemunca sau munca la domiciliu, in afara programului de lucru redus conform dispozitiilor prezentei ordonante, constituie contraventie si angajatorul se sanctioneaza cu amenda de RON 20.000 pentru fiecare persoana astfel identificata, fara a depasi valoarea cumulata de RON 200.000.

On 10 August 2020, the Government Emergency Ordinance no 132/2020 regarding the establishment of certain support measures for the employees and employers […] (“GEO no 132/2020”) was published in the Official Gazette.
GEO no 132/2020 entered into force as of 10 August 2020, except for the provisions related to the sanctions which shall become effective after 30 days from the date of publishing.
I. Reduction of the working time up to 50%
In case of temporary reduction of the activity caused by the establishment of the state of emergency/ alert/ siege, the employer has the possibility to reduce the working time of the employees by at most 50% of the duration provided in the individual labor agreement (“ILA”), provided that the following conditions are met:
- the measure of reducing the working time affects at least 10% of the employees from the respective unit;
- the reduction of the activity is based on a decrease of the turnover (i) from the month prior to the application of the measure, or, at most, (ii) from the month before the previous month by at least 10% in comparison with the similar month of the previous year;
- prior consultation of the union, the representatives of the employees or the employees is performed;
- the reduction is valid for a period of at least 5 consecutive working days;
- the decision shall be communicated to the employee at least 5 days before its application and shall be registered with REVISAL (latest) on the day before.
During the reduction of the working time, the affected employees benefit from an indemnity of 75% from the difference between the gross basic salary provided in the ILA and the gross basic salary related to the hours effectively worked.
II. Provisions regulating the indemnity
The above-mentioned indemnity is borne by the employer and is settled from the unemployment insurance budget.
The procedure for the settlement of the amounts and the period of application of the measure shall be determined by decision of the Government (to be enacted in the next 30 days).
If the employer does not recover the indemnity from the unemployment insurance budget, it cannot recover the said indemnity from the employee.
Employers owe the insurance contribution for labor for the reduction of working time, both for the salary rights related to the working time, and as well for the indemnity.
The indemnity shall not be cumulated (for the same employee) with:
- the support measure for determined period of employment (granted under the same GEO no 132/2020);
- the active support measures granted according to art. I and III of GEO no 92/2020 (i.e. the settlement of a part of the salary for a period of 3 months and, respectively, the benefits for the employment of certain categories of persons between 1 June 2020 and 31 December 2020);
- the support measures for stimulating the employers financed from the unemployment insurance budget, granted under the Law no 76/2002.
III. Interdictions
During the reduction of working time, the following activities are prohibited:
- hiring personnel for similar or identical activities to those provided by the employees whose working time was reduced;
- subcontracting of activities provided by the employees whose working time was reduced.
The interdiction is also stipulated for branches, subsidiaries and other secondary offices provided by the Companies Law no 31/1990.
- performing supplementary time work by the affected employees;
- reduction of working schedule for employees based on Article 52 para. (3) of the Law no 53/2003 regarding the Labor Code;
- initiation of collective dismissals.
IV. Teleworking
The employers benefit, for each employee, of a financial support of RON 2,500 for the performance of teleworking, in order to purchase technological assets and services necessary for the teleworking activity.
The RON 2,500 may be accessed, until 31 December 2020, from the unemployment insurance budget for the employees who performed teleworking during the state of emergency (i.e. 16 March – 15 May 2020) for at least 15 working days.
The manner of granting and the categories of goods that can be acquired shall be established by order of the Labor and Social Protection Minister, within 10 days as of the publication of GEO no 132/2020.
V. Sanctions
It is considered a contravention to perform any type of work, including telework or working from home, outside the reduced working time according to the provisions of the herein ordinance, and the employer shall be sanction with a fine of RON 20,000 for each person thus identified, without exceeding the cumulative value of RON 200,000.
